High Court Allow Local Con Man to Appeal

The High Court recently reduced the Magistrate's Court decision on a sentence of imprisonment handed to a local man for cheating people off their money.
Pengiran Asmadi bin Pengiran Ali pleaded guilty on September 9, 2015 to five charges of cheating three individuals by cheating them of their money in a bogus gold investment scheme in October and November 2009, July 2010 and February 2012.
He was sentenced to serve a term of four years and eight months.
In the appeal by Pengiran Asmadi, DPP Vuina Song submitted that the Chief Justice Dato Seri Paduka Haji Kifrawi bin Dato Paduka Haji Kifli should reconsider the court's evaluation on coming to the sentence.
The imprisonment sentences on each charge was to be carefully considered and passed as concurrent instead of consecutive to one another as the offences against the same victim should be quantified as arising from the same transaction.
The Chief Justice allowed the appeal and reduced the Magistrate's Court sentences to a total of three years and six months.
Despite the variation in sentence, the Chief Justice agreed with the Magistrate's Court approach in considering the 'ponzi' scheme as a premeditated and well planned crime, requiring a deterrent sentence.
