Lawyer Sought Probationary Order for Client Following Delayed Prosecution

The lawyer of a local man accused of using a counterfeit $500 note sought for a probationary order from the Intermediate Court for his client citing delayed prosecution of the case.

 

The defendant, Mohd Yaakub bin Taib, was charged in 2013 for handing an attendant at Roxana petrol station in Seria a counterfeit $500 note after filling fuel in his car on the night of March 19, 2005.

 

He had claimed trial ever since, and was found guilty and convicted by Judge Haji Abdullah Soefri bin Pehin Dato Haji Abidin last Saturday.

 

Defence counsel Yusuf Halim asked the court to consider the small amount involved despite it being a serious offence, the delayed prosecution of the case and not take into account the defendant's previous convictions - one for theft 37 years ago and another for house-trespass 28 years ago.

 

Last Saturday, Judge Haji Abdullah found that the evidence submitted by Deputy Public Prosecutor Raafe' Ibrahim and prosecution witnesses has proved the case beyond the court's reasonable doubt.

 

Mohd Yaakub, faces a maximum jail term of 15 years with a fine.

 

Yesterday, Deputy Public Prosecutor Farhanah Suhaili stood in for the prosecution and Judge Haji Abdullah fixed the case for further mention on April 21 to allow social welfare authorities prepare a report on the defendant before passing the sentence.
