Seri QLap Mall Owners Filed Lawsuit Against Tenant for Allegedly Not Paying Rent

In a recent civil suit involving the owners and a tenant of Seri QLap Mall, the High Court decided that the case is to be tried in full with witnesses from both parties, denying plaintiffs' application for a summary judgement against the defendant for allegedly not paying rent.
Lim Kim Peck, Heu Guan Hoon and Dato Paduka Lim Beng Thai are part owners of Seri QLap Mall building.
Dato Lim's son Lim Jin Yong entered into a tenancy agreement with the plaintiffs, and Lim Jin (defendant) on July 6, 2010 agreed to pay a monthly rental of $10,210 to the plaintiffs commencing September 6, 2012.
The plaintiffs had claimed payments from Lim Jin Yong amounting to $311,520.32 as arrears.
The defendant Lim denied having arrears as he had given a notice of termination of the tenancy to Dato Lim in his capacity as an equal owner of the building and that he had surrendered the premises to the Seri QLap Mall business in July 2012.
Chief Justice Dato Seri Paduka Haji Kifrawi bin Dato Paduka Haji Kifli said that the issues between the plaintiffs and the defendant can only be resolved by the court through the process of a full trial by calling the relevant witnesses of both parties.
The plaintiffs are represented by Rozaiman Abdul Rahman of Messrs Rozaiman Abdul Rahman while the defendant is represented by Charles Lim of Messrs HEP Law Office.
