The Ministry of Health, in a press release, would like to alert members of the public to eight types of traditional medicines and health products as well as one cosmetic product which have been tested by the Laboratory of Pharmacy Section, of the Ministry of Health, and found to be adulterated with undeclared, potent western medicine. The adulterant found in these products can cause adverse effects that are potentially hazardous to consumers.
The Ministry of Health has never issued any approval for the importation for the sale of these products, nor Cosmetic Notification Acknowledgement Letter. Therefore, the products are not allowed to be imported and sold in Brunei Darussalam. Members of the public who have purchased or used them are advised to stop using them immediately.
It is an offence under the Poisons Act 1956 to sell any product containing any substance controlled under the said Act and the penalty for such an offence upon conviction is a fine of 8-thousand dollars or six months imprisonment. Any party who commits an Act that amounts to such a degree of negligence so as to endanger or be likely to endanger a human life is liable to a penalty of a 16-thousand dollars fine and 12 months imprisonment.
Furthermore, it is an offence under the Medicines (Cosmetic Products) Regulations, 2007 to import and market cosmetic products in the local market without a Cosmetic Product Notification Acknowledgement Letter issued by the Authority, which carries a penalty of not more than 5-thousand dollars in fine, imprisonment for a term not exceeding two years, or both.
