The Court of Appeal recently rejected an appeal filed by a local thief against his sentence of 40 months’ imprisonment with two whippings for daytime and night break-ins.
Presiding Justice John Barry Mortimer, flanked by Justices Seagroatt and Burrell, found the Intermediate Court’s sentence on Mohd Afiqen bin Karimto be a fitting punishment after taking into accounts the mitigating and aggravating factors of the case including its totality principles.
DPP Muhd Aiman Adri bin Haji Ahmad Zakaria represented the Public Prosecutor as respondent in the appeal.
