Jail Sentence for 9 on Criminal Breach Of Trust

Nine mariners of a ship used by Brunei Shell Petroleum Company Sdn Bhd (BSP) were sentenced to jail for Criminal Breach of Trust by the Magistrate's Court yesterday.
The defendants admitted pumping diesel fuel out of SMS Discovery into another unknown vessel.
Muhammad Ali, the Indonesian Captain of Utility Support Vessel SMS Discovery received 16 months in jail while the ship's Indonesian crew - Sudarto, David Juliansen and Afrizal Firdaus received 24 months
in jail, Mochlis Sodikin and Andhika Pramuditya got 32 months in jail and Nur Alam Syah, Novrian and Arham Alias received 16 months in jail.
The defendants involved each other in a conspiracy which resulted in the misappropriation of 30,000 litres of diesel which caused a loss worth $16,500 to BSP. The offence took place on two occasions - between November 16 and 17, 2016 and between December 7 and 8, 2016.
SMS Discovery is operated by PT Wintermar while the captain and his crew are employees of PT Wintermar and a local subcontracting company named KTL Services Sdn Bhd.
The ship was in the vicinity of Champion 7, Southern Anchorage, Champion Oilfield when they committed the offence. They defendants admitted in receiving their shares from the illegal sales. Prior to that they sketched up a plan to sell the stolen diesel from SMS Discovery over a period of time and agreed to divide the proceeds among themselves.
Police seized a total of RM71,335 onboard the ship, some of which were kept hidden. The money was collected from the illegal sale of the diesel.
Chief Magistrate Muhammed Faisal bin Pehin Dato Kefli presided over the case. DPP Emily Goh represented the Public Prosecutor.
