Magistrate's Findings in Corruption Case Upheld

The high Court yesterday upheld the Magistrate's Court's findings in a trial against a corrupt customs officer.
The Magistrate's Court convicted Mohd Sanip bin Ura on four counts of accepting bribe money and gratification in the form of sexual services by a prostitute from a fuel smuggler.
Representing the applicant is Lawyer Shazale Mat Salleh who raised the issues whether the trial magistrate was correct in accepting the evidence of the main witness, whether the trial magistrate had erred in relying on the video evidence purporting showing the receipt of gratification by the appellant, whether the trial magistrate was correct in his finding that the appellant's statement was voluntarily made and whether the convictions were safe or against the weight of evidence.
"These are findings by the Magistrate who has seen the appellant and witnesses first hand and find nothing in the judgement that was either wrong in law or against the weight of the evidence to justify me to interfere with the conviction," said Justice Dato Paduka Haji Hairol Arni bin Haji Abdul Majid in dismissing the appeal.
DPP Hajah Anifa Rafiza binti Haji Abdul Ghani was respondent in the appeal.
