Bandar Seri Begawan - A 33-year-old local man, who earlier pleaded guilty along with two juveniles to charges of theft, housebreaking, misappropriation and mischief, was sentenced to jail for three years and six months with two strokes of the cane.
Senior Magistrate Pg Masni Pg Hj Bahar sentenced 33 year-old Talip bin Hj Joferi yesterday following his guilty pleas on all seven charges of theft and mischief.
The Magistrate's Court postponed making a decision on the two juvenile boys to consider whether they will be tried in the juvenile court under the Children and Young Person's Order or in the adult courts.
The juveniles will be produced again on January 12, 2013 for the court's decision.
The 16-year-old and 17-year-old's bails of $5,000 or in one local surety were extended pending the decision.
Raddyman bin Awg Hj Radin, 31, released on bail of $5,000 or in one local surety, and who denied all seven charges of theft and mischief yesterday appeared to have his case heard again on January 10, 2013.
The prosecution strongly urged the court to sentence the two juvenile defendants as adults in the courts yesterday as one of them had worked his way from committing simple thefts to housebreaking and mischief.
The other juvenile defendant was not playing an important role. However, he did partake and it was a matter of chance if he been more involved.
On the first count, Talip brought his car and drove to Restaurant Bahagia Teratur in Kg Kiarong, bringing with him the 16-year-old boy in the wee hours of December 9 and 10, 2012. The defendants broke into the restaurant through the back door which Talip had pried open.
Talip and another a person stole a 32" television set, a gas cylinder, a water dispenser, an electric drill and an Astro Beyond receiver and its card belonging to the restaurant.
Talip, the 17-year-old defendant and another person, on the second count, went to a house at Kg Mata-Mata using Talip's father's car on December 15, 2012.
They cut the padlock on the iron fence of the front door, pried the door open and entered the house.
They left the house after taking a 32" television set with remote control, a laptop with charger and two speakers.
The third count stated that the defendants involved in the third charge had committed mischief by causing damage to the home owner's property.
On the fourth count, Talip alone stole a parabola satellite dish from Flat JPA in Kg Kiarong between during the wee hours of November 5 and 6, 2012.
The 16-year-old defendant was withdrawn from facing this fourth charge amounting to an acquittal.
The fifth charge stated that Talip and both of the juvenile defendants stole a parabola satellite dish from a flat in Kg Kiarong on November 17, 2012.
The sixth charge stated that Talip and the 17-year-old defendant dismantled and took a parabola satellite dish from Aprina Enterprise compound in September 2012, and is an offence of dishonestly misappropriating property. The seventh charge stated that Talip and the 17year-old defendant again dishonestly misappropriated property by dismantling and taking away a parabola satellite dish from the compound of Telanai Heights in October 2012.
Prosecuting Officer Ak Shahyzul Pg Abd Rahman prosecuted the case.
