Josh Brolin seems to have discovered the precise point where happy New Year officially becomes crappy New Year.

That's the moment when the cops arrest you for public intoxication, as happened to Brolin on New Year's Day at 11:30 p.m., Santa Monica police tell E! News. The Gangster Squad actor was popped for the petty infraction on the 1600 block of Ocean Avenue.

"He was intoxicated and unable to care for himself," said SMPD spokesman Sgt. Richard Lewis. "He was booked and released with no further action pending."

But not before his unsmiling countenance was immortalized in this booking portrait.

Here's hoping the rest of 2013 is better for Brolin.
