High Court Dismisses Woman's Rape
Claim
By Ignatius Stephen
Bandar Seri
Begawan - A 42-year-old woman who alleged that a man in his
30s raped her on September 12 in Kampong Menglait had her charge
thrown out in the Brunei High Court.
The alleged victim, a Filipino,
said she was abducted from the roadside at knifepoint by the man who
forcefully had sex with her four times after locking her up in his
house. The man, a construction company coordinator, denied the
charge saying that she went to his house voluntarily to do some
cleaning.
The High Court Judge Madam Lim Siew
Yen after hearing all the evidence said that she did not believe the
woman, a mother of two, referred to in court as Miss X.
The court in dismissing the case
suggested that the allegation could be the result of her bitterness
against the man for not paying her $100 that she asked for after she
had performed a "service" for him.
The judge said that she did not
believe that there was abduction or any rape. The discrepancy in
Miss X's evidence was too rampant to be ignored, the court ruled.
"In the face of so much unreliable
evidence from the prosecution witnesses, it is unsafe for me to
convict the defendant," the judge said in acquitting him.
DPP
Dayangku Hajah Hana Molina was for the prosecution. Rudy Lee Kim
Boon and Selvanathan Sunramaniam of Ms Fathan, Rudi Lee &Associates
defended.
