42 Associations Declared Void

Begawan - The registration of one of Brunei's three political
parties, Parti Kesedaran Rakyat Brunei or the Brunei People
Awareness Party (PAKAR), has been rendered void by the Registrar of
Societies (ROS) along with 41 other associations or clubs.

According to a Police statement
yesterday, the cancellation of the associations' registration
was implemented in accordance with Section 13(1) (a) and Section
13(1) (d) of the Societies Order 2005.
Some of the clubs were
registered way back in 1950s while the latest association was
registered in 2001.
The associations are from the
four districts and some of them include football clubs, farmers
associations, fraternal organisations and village groupings.
One of the reasons of the
cancellation of registration, as stated in the press statement,
was the failure of some of the associations' members to forward
their annual reports as specified under the Societies Order.
These associations were reminded several times to submit their
annual reports but failed to do so, leaving the ROS to enforce
the cancellation. |

The cancellation of registration of
an association under Section 13 (1) (a) over internal feud was
also mentioned in the statement.
The affected association failed
unanimously to appoint its committee members even though it was
given a timeline to do so. The ROS took the decision to enforce
cancellation as stipulated under Section 24 (2). |
The Brunei People Awareness Party (PAKAR)
was the only association from the 42 listed whose registration was
cancelled due to internal feuding.
As a result of the cancellation,
these associations are now considered illegal and any activities
conducted henceforth can lead to serious consequences under the
Societies Order.
Those found guilty can be fined not
more than B$15,000 or jailed not more than five years or both.
Under Section 15(1), committee
members of the association that have been de-registered are not
allowed to hold any other position in another association without
written permission from the Registrar of Societies.
If they continue to hold such
positions without permission, they face a B$15,000 fine or a jail
sentence of not more than five years or both.
The cancellation of registrations
will be effective for five years from the day associations have been
de-registered.
The ROC, meanwhile, reminded
committee members of associations who are registered with the
Registrar of Societies to submit their annual reports. It also
stated that it will continue to monitor these associations and clubs
and will take appropriate actions stipulated under the Societies
Order 2005.
