Bandar Seri Begawan - The Bandar Magistrate's Court recently imposed an eight-months' jail term and 12 strokes of the cane on a 22-year-old man who had admitted to a charge of attempted rape of his 13-year-old niece.

The court heard that on November 26 last year, the defendant had picked up his niece from school and instead of taking her home, he drove her to an isolated area at Perpindahan Kg Bukit Beruang, and attempted to rape her.

The defendant later instructed the victim not to tell anyone what had happened. `Greatly distressed and crying,' the victim told her mother what had happened and a police report was lodged.

An examination was conducted on the victim.

In delivering the judgment, the High Court judge said, "This is a serious case of attempted rape.

There are several aggravating features present. First, the victim is a young girl. Second, there was a gross breach of trust as the defendant was the victim's uncle and he was responsible for bringing her home from school safely.
