Three Companies Fined For Failure
To Furnish Tax Returns

Begawan - Three local companies were brought before the
Bandar Magistrate's Court yesterday for contravention of section
78(1)(a) of the Income Tax Act (Cap. 35).
Each of the three companies was
separately charged with failure to furnish the Collector of Income
Tax with a return of income and such particulars as may be required
for the purpose of ascertaining the income tax chargeable to the
companies.
The first company, Hussyn Livestock
Co Sdn Bhd, was charged with failure to furnish the Revenue Section,
Ministry of Finance with the relevant Return of Income and
Particulars Form that are required for the purpose of ascertaining
the income tax chargeable to the company for the years ended 2006,
2005 and 2004. The company, represented by its Managing Director, Hj
Mohd Hussin bin Hj Abd Rahman, pleaded guilty to all the three
charges. The Magistrate's Court imposed a total fine of $3,000 or
three months' imprisonment in default of payment.
Meanwhile, Sunokoh Timber Company
Sdn Bhd, represented by its Director, Koh Huan Chuan, facing the
same charges for the years ended 2006, 2005, 2004 and 2003, was
fined $4,000 or four months in jail after pleading guilty to all
four charges.
The third company, Linknet
Solutions Sdn Bhd, facing a total of three same charges, for the
years ended 2006, 2005 and 2004, was fined $3,000 or three months'
jail in default. The company was represented by its Managing
Director, Wong Hong Chee.
Failure to comply with the notice
or non-submission of a Return of Income and Particulars Form,
including the annual audited accounts, is a criminal offence
punishable under section 78(2) of the Income Tax Act (Cap 35) with a
fine of $10,000 and in default of payment, imprisonment for 12
