Submit Annual Census Or Face Fine,
Labour Dept Warns

Begawan - The Labour Department will take legal action against
employers who fail to submit their annual census forms by February 28,
2005.
Those who fail to do so will face a
fine of $2,500 and an imprisonment term of six months if found guilty.
in the event of a continuing offence, a further fine of $50 shall be
imposed per day.
The Labour Department through
Research and Statistics Section has been conducting its annual census
of employer and employees on wages, rate earnings and working hours
for the year 2004.
According to a press release from the
Ministry of Home Affairs, the census applies to every employer, who is
registered with the Labour Department, and those who have been given a
license to employ foreign workers, except the government, and those
who employ for the purpose of domestic helpers and personal services
(amah).
The census is required as provided
under section 3(1), Cap 99 of the Employment Information Act 1974.
For companies which have ceased
operations or are inactive, they are exempted from furnishing the
information, provided they have informed the department in writing.
In order to give employers more time
to collect and submit the forms, the Labour Department reminded
employers that they need to collect and submit forms to the Research
and Statistics Section, 5th floor, Labour Department at Jalan Mentiri
Besar or the nearest district branches during office hoursbefore or on
February 28.
