Man Loses Appeal For No 'Special
Reasons'

Begawan - Judge Dato Paduka Steven Chong yesterday dismissed
the appeal of a local in the High Court against his disqualification
order from driving for 12 months.
His disqualification order came after
being convicted of driving a car with a four-month expired license and
uninsured against third party risks, The appellant, Pg Sharifuddin Pg
Rendah asked for the disqualification order to be quashed on the
grounds that it caused hardship to him and his family having to rely
on relatives, friends and the bus service for transport.
"Clearly, the factor relied upon
by the appellant cannot constitute a 'special reason' for not
disqualifying him as it is personal to him and not connected to the
offence at all," Judge Chong said in dismissing the appeal.
Upon conviction under section 3(1) of
the Motor Vehicles Insurance (Third Party Risks) Act, it is mandatory
pursuant to section 3(2) of the same that the offender be disqualified
from holding or obtaining a driver's license for a period of 12 months
or longer, unless there are 'special reasons' for not doing so.
Earlier, the Magistrate's Court also
imposed a $200 fine for driving the car with an expired license
contrary to section 8(1) of the RTA, and $600 for not being insured
against third party risks contrary to section 3(1) of the Motor
