A Royal Brunei Armed Force
recruit has won his appeal for fines imposed by the High Court
to be made by instalments. However, Judge Dato Paduka Steven
Chong dismissed the appeal for his driving disqualification
order to be quashed.
"In view of the
appellant's financial circumstances, I shall give him a period
of 6 months to make full payment. If he defaults in payment he
will serve the 12 weeks' imprisonment which was ordered by the
Magistrate earlier," Judge Chong said.
But Judge Chong found out that
the factor relied upon by the appellant in his appeal against
the disqualification order cannot be considered as a special
reason as it is directly connected to the appellant and not the
offence.
The appellant in his earlier
mitigation in the Magistrate's Court said that the
disqualification order has made him difficult to travel from his
home to the camp.
