Uncle beats niece for ‘Syabu’ accusation

A veteran citizen was imposed a $2,500 fine or 2 months jail in default by the Magistrates’ Court instead of a custodial sentence after being convicted under section 323 of the Penal Code yesterday. The sentence was imposed after a trial regarding the case of the defendant having voluntarily caused hurt to his niece.

Pg Metali Pg Hj Othman was only imposed a fine and not a custodial sentence which is carried by section 323 of the Penal Code as Chief Magistrate Dk Rostaina considered that he was a first offender, his age being quite old and that he had 15 children to support.

The facts of the case were revealed that Pg Metali was furious when he heard that his niece, Karmiela bte Bisman, had told the people in their village that he sold Syabu. He then promptly went to a house at No.960 in Kg Pg Setia Negara on January 21, 2002.

It was at 8.30 am on that day that Pg Metali voluntarily caused hurt to Karmiela by punching and kicking her, which caused several bruises on her body and left her eyes swollen.

In the trial before, Pg Metali wrote a letter to the court swearing that he had never sold Syabu.
