Ex-rigger's Appeal Dismissed
By Rol Ezam
Bandar Seri
Begawan - Judge Dato Steven Chong dismissed a 33-year-old ex-
oil rigger's appeal in the High Court against his sentence the
Magistrate's Court imposed earlier.
The appellant, Kamsul Mustafa was
convicted on his own plea of three counts of consuming
Methylamphetamine, a class A controlled drug.
Originally the Magistrate, Radin
Safiee Radin Mas Basiuni, sentenced the appellant to three-and-a-half
years imprisonment on each count to run concurrently.
According to the statement of facts,
all the three offences were committed in July two years ago, whilst he
was placed under the supervision of the Narcotics Control Bureau.
The supervision order was made after
the appellant was convicted of a section 6(b) offence under the MDA,
five months before he committed the offence, for which he was fined
$1,000.
"Having regard to the
appellant's commission of three drug consumption offences in one
month, and within a period of less than five months from his previous
conviction for a similar offence, I do not think the sentence is in
the least excessive," Judge Steven Chong said before dismissing
the appeal. (Courtesy of
