Luck Runs Out For Night School
Student
By Rol Ezam
Bandar Seri Begawan -
A night class
student at SOAS College, who pleaded guilty to two road traffic
offences earlier in the Magistrate's Court, made an appeal in the High
Court against his driving ban order, but he did not succeed.
The appellant, Hj Abd Azim Hj Abd
Wahab was imposed fines of $400 for using a car with an expired
vehicle license and using a car when he was not insured against Third
Party Risks, for which he was fined $800.
And the Magistrate, Faisal bin Pehin
Dato Hj Keiflie also disqualified him from holding a driver's license
for 12 months.
Hj Abd Azim however lodged an appeal
before Judge Dato Steven Chong for the 12-month driving ban order to
be set a side on the ground that it was inconvenient having to rely on
his brother-in-law for transport.
However, the Judge found clearly that
all the factors he said were connected to the offence and therefore
could not be constituted as a special reason for not disqualifying him
from driving.
Upon conviction of the Motor Vehicles
Insurance (Third Party Risks) Act, it is mandatory that the offender
be disqualified from holding or obtaining a driver's license for 12
months or longer, unless there are 'special reasons' for not doing so,
it was pointed out in court. (Courtesy of
